ACOL Skylights & Roof Windows Pty Ltd (T/A Splendid Skylights)


1. Introduction

These Terms & Conditions govern the sale of products by Splendid Skylights, a trading brand of ACOL Skylights & Roof Windows Pty Ltd ('Splendid Skylights', 'we', 'our', 'us'). By placing an order through our website, you agree to these Terms & Conditions. Unless expressly agreed otherwise in writing, these Terms & Conditions apply to the
supply of products only.


2. Product Information

We make reasonable efforts to ensure product descriptions, specifications, images and pricing are accurate at the time of publication. Splendid Skylights continually improves its products and manufacturing processes. As a result, product specifications, dimensions, finishes, components, accessories, packaging and manufacturing methods may change from time to time without notice. Minor variations in dimensions, appearance, colour, finish, materials, hardware, accessories and supplied components may occur between production batches and do not constitute a defect. Product photographs, drawings, brochures, installation examples and website content are provided as a guide only and may not reflect the exact product supplied at the time of delivery. Splendid Skylights reserves the right to substitute equivalent or improved components where necessary, provided the product's intended functionality and performance are not materially reduced.
Where multiple products are intended to be installed together on the same project, Splendid Skylights recommends that all products be ordered at the same time. Products ordered at different times may contain updated components, accessories, finishes or manufacturing changes and may not be visually identical to earlier purchases. Customers are responsible for ensuring products selected are suitable for their roof type, roof pitch, building design and intended application. Product information provided by Splendid Skylights is general in nature and does not constitute engineering, architectural, structural or building compliance advice.


3. Orders

All orders are subject to acceptance by Splendid Skylights. We reserve the right to decline or cancel an order where product availability changes, pricing errors occur, product specifications require clarification, or fraudulent or suspicious activity is detected. If an order is cancelled before dispatch, any payment received will be refunded in full.


4. Pricing & Payment

All prices are shown in Australian Dollars (AUD). Unless stated otherwise, prices include GST. Full payment is required before dispatch of goods. Ownership of goods remains with Splendid Skylights until payment has been received in full.

5. Delivery

Delivery charges are calculated at checkout or quoted separately where required. Some products are shipped in large cartons or on pallets and may require manual assistance, lifting equipment, forklift access, pallet-jack access or other suitable unloading arrangements at the delivery address. The customer is responsible for ensuring suitable access and unloading arrangements are available at the delivery address where required. Freight drivers are not required to manually unload goods, carry goods into buildings, or move goods beyond the delivery point determined by the freight carrier. Where the customer is unable to provide the necessary unloading assistance or equipment, the freight carrier may, at its discretion and where available, provide additional unloading services. Any additional freight, unloading, handling, waiting time, re-delivery or access-related charges incurred as a result of insufficient unloading arrangements at the delivery address may be charged to the customer at cost. By placing an order, the customer agrees to pay such reasonable additional charges where they are incurred. Splendid Skylights will endeavour to advise customers of known delivery, access or unloading requirements prior to dispatch where reasonably foreseeable. However, responsibility for ensuring suitable delivery access and unloading arrangements remains with the customer. Delivery dates are estimates only and are not guaranteed. Splendid Skylights is not liable for delays caused by freight carriers, weather events, supply shortages, industrial action or other circumstances beyond our reasonable control. Delivery is deemed complete when the goods are made available at the nearest safe and accessible location determined by the freight carrier.

6. Inspection Upon Delivery

Customers should inspect all products as soon as reasonably possible after delivery and before arranging, commencing or attempting installation. Any claim for freight damage, shortages or incorrect supply must be accompanied by clear photographs of the delivered product, all packaging and cartons, any visible damage, and the condition in which the goods were received. Customers should retain all packaging materials until the inspection process has been completed. Failure to inspect products prior to installation may affect our ability to investigate freight damage or delivery-related claims. Where freight damage is alleged, Splendid Skylights may request delivery photographs, packaging photographs and supporting information from both the customer and the freight carrier as part of its investigation. Installation of a product shall be deemed acceptance that no obvious
freight damage existed at the time installation commenced.

7. Returns and Change-of-Mind Policy

Standard stocked products may be returned within 30 days of delivery where approved by Splendid Skylights, provided the product is unused, uninstalled and remains in original saleable packaging. Freight costs and a reasonable inspection and restocking fee may apply. The customer is responsible for any loss or damage occurring during return transport. Custom-made, modified and special-order products are not eligible for change-of-mind returns, including custom flashing trays, non-standard colours, custom glazing options and custom sizes.

8. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under Australian Consumer Law. Customers may be entitled to repair, replacement, refund or other remedies where required by law.

9. Product Warranty

Product warranties are governed by the applicable Splendid Skylights Warranty document published on this website. The Warranty document should be read together with these Terms & Conditions. Where any inconsistency exists between these Terms & Conditions and the published Warranty document, the Warranty document shall prevail in relation to warranty matters.


10. Product Use and Installation

Splendid Skylights provides installation instructions and technical resources, which may include PDF installation guides, videos and other supporting materials. These resources should be reviewed before commencing installation, as different products, roof types and applications may require different installation methods. Flashing trays, roof windows, skylights and accessories may have separate installation instructions.

Where multiple instructions apply, all relevant instructions should be followed. The customer and installer are responsible for ensuring products are installed in accordance with the supplied instructions, applicable building requirements and local regulations. Roof penetrations require appropriate skill, care and consideration. The customer is responsible for determining whether installation may be undertaken by themselves or by an appropriately qualified trade contractor. Electrical work must be carried out by appropriately licensed persons where required by law. Construction of plaster shafts, timber framing,plasterboard lining, painting and other building works are not covered by our installation instructions unless expressly stated otherwise and remain the responsibility of the customer and installer. Interior plasterboard, lining and finishing materials must not contact the glass or glazing unit and should be installed with appropriate clearance in accordance with the supplied instructions.


11. Limitation of Liability

To the maximum extent permitted by law, Splendid Skylights' liability is limited to repair, replacement or refund of the supplied product. Except where required by Australian Consumer Law, Splendid Skylights is not liable for removal or reinstallation costs, roofing, plastering, painting or electrical costs, contractor costs, project delays, loss of rent, loss of profits, consequential losses or third-party costs. Splendid Skylights does not accept any form of retention monies, set-off, back-charge, liquidated damages, delay damages, penalty claims or similar deductions from amounts owing. All invoices must be paid in full and may not be reduced, withheld or offset by any alleged claim unless required by law.


12. Privacy

Personal information collected through our website is handled in accordance with our Privacy Policy.


13. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any dispute arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of Victoria.
